Aaptiv Consumer Health Data Privacy Notice

This Consumer Health Data Privacy Notice (“Notice”) supplements the information contained in the Pear Health Labs Inc. dba Aaptiv (“Aaptiv,” “we” “us,” or “our”) online Privacy Policy, and applies solely to personal data defined as “consumer health data” subject to the Washington My Health My Data Act (“MHMDA”), the Nevada Health Data Privacy Act (“NHDPA”), or other applicable state consumer health privacy law.
What Does This Privacy Notice Cover?
This Notice describes what consumer health data we collect, how we collect and use it, to whom we disclose it and why, and the choices you may have regarding our use or disclosure of your consumer health data. This Notice only applies to consumer health data, which is a subset of personal information that identifies your past, present, or future physical or mental health status. Examples of consumer health data are provided below.
What Categories of Consumer Health Data Do We Collect?
We may collect or receive the categories of consumer health data listed below. Not all categories will be collected or received for every individual.
- Activity and Fitness Metrics. Such as steps, distance, workouts, exercise minutes, active/resting energy, activity type, and movement data.
- Body Measurements and Physical Characteristics. Such as height, weight, BMI, and body composition metrics (if available through the integration).
- Vital Signs and Related Metrics. Such as heart rate, heart rate variability, respiratory rate, and similar measurements (if available through the integration).
- Sleep Information. Such as sleep duration, stages, and sleep schedule (if available through the integration).
- Nutrition and Hydration Information. Such as caloric intake and related nutrition logs (if available through the integration).
- Other Health or Wellness Data. Such as mindfulness minutes, reproductive health-related tracking, or other data categories made available by an integration and authorized by you (if applicable).
What Are the Categories of Sources From Which We Collect Your Consumer Health Data?
We may obtain consumer health data from different sources, as described in the “Information We Collect Through the Services” section of the Aaptiv Privacy Policy. This includes data collected directly from you, from your interaction with our websites, apps, and services, and from third parties.
What Are the Purposes for Collecting Your Consumer Health Data?
We collect and use consumer health data for the purposes described in the “How We Use Information We Collect” section of the Aaptiv Privacy Policy. Primarily, we collect and use consumer health data as reasonably necessary to provide you with the products and services you have requested or authorized. This may include delivering and operating our mobile apps and websites and their features, ensuring the secure and reliable operation of the services, troubleshooting and improving the services, and other essential business operations that support the provision of the services (such as analyzing our performance, meeting our legal obligations, and conducting research and development).
We may use consumer health data for additional purposes for which we obtain your consent as required by law.
How Do We Share Your Consumer Health Data and Why?
We may share each of the categories of consumer health data described above for the purposes described in the “How We Use Information We Collect” and “How We Disclose Information” sections of the Aaptiv Privacy Policy. In particular, we may share personal data, including consumer health data, with your consent or as reasonably necessary to complete any transaction or provide any services or products you have requested or authorized, as described above.
We may share consumer health data with our service providers such as those providing technology and business operations, governmental agencies and legal bodies, purchasers of or successors to our business or assets, and other third parties where you have provided your consent for such disclosure.
How Can You Exercise Your Consumer Health Data Rights?
If you are covered by the MHMDA, the NHDPA, or other applicable consumer health privacy law, then you may have certain rights with respect to your consumer health data, including the right to (1) request access to your consumer health data; (2) confirm whether we have disclosed or sold your consumer health data; (3) delete your consumer health data; or (4) withdraw your consent or authorization relating to such data. You can make these requests by contacting us as described below. You have the right to appeal our decision with respect to a request you have submitted by contacting us as described below.
Updates to This Privacy Policy
We reserve the right to modify this Notice at any time to reflect changes in our practices, services, or legal obligations. Any modifications will be effective upon the date specified in the updated Notice. If we make material changes to this Notice that significantly affect your rights or the way we collect or use your consumer health data, we will notify you through the most appropriate channels. Generally, this will be done by updating the date at the top of this page. However, other notification methods may include sending an email to the address you have provided, posting a notice on our websites, apps, or services, or other methods as required by law.
